  1. Payment for this invoice must be made in full before the goods will be released for delivery / collection. Each delivery is considered a separate contract and the price thereof is payable accordingly. Goods remain the property of Toads until they are paid for in full.

  2. Changes / cancellation of orders will be accepted within the first 5 (five) days of placing the order.

  3. Acceptance of this invoice from Toads constitutes a Contract of Sale between the parties, subject to the terms & conditions as laid out here with which the customer consents to.

  4. Please note that whilst every effort is made to fulfill orders correctly, should you be branding your goods with another company, you are required to check all items received from Toads BEFORE they get branded. Toads will not accept returns on incorrect items which have already been branded.

  5. Any products returned to us, either for credit or exchange, must be returned within 14 days of receipt and must be unused / unworn, and packed in its original packaging. Used, worn or soiled products will not be accepted by Toads. A handling charge of 20% (twenty percent) of the value of the invoice will be charged on all goods returned for credit. A special picking fee of 10% of the value of the invoice will be charged on goods ordered and subsequently cancelled.

  6. Size curves for garments are provided on the price list, to help you select the correct size. Should your garments not fit correctly, you may return these to exchange for alternate sizes. This must be done within 14 days of receipt of the order by the customer. The delivery costs for the return / exchange of goods will be covered by the customer.

  7. Should you encounter items missing from your parcel or damaged goods, this must be reported to Toads within 24 hours of receipt of the parcel. Damaged items must be returned to Toads for inspection, if the claim is recognized, replacement goods will be delivered to the customer, with delivery cost covered by Toads. Claims in respect of faulty goods / short delivery shall not be grounds for withholding payment and shall not give the customer any right to set off the claim amount against payments due to Toads.

  8. Should the customer elect to collect goods via nominated driver or courier service, the customer agrees that any liability for shortages / damages to goods will pass to the customer upon collection of the parcel from Toads premises.

  9. Toads does not guarantee delivery on any specific date but will endeavor to give delivery on dates as agreed between the parties. Toads does not accept responsibility for claims of damages arising from non-delivery of goods on due date.

  10. Any dispute which cannot be settled by negotiations between Toads and the customer, shall be subject to the jurisdiction of the Germiston Magistrates Court, to which jurisdiction the customer hereby consents.
